The legal basis

Electronic signatures are legally recognised in England and Wales for documents like terms of business, under the Electronic Communications Act 2000 and the UK eIDAS Regulation. An electronic signature captured this way is treated as the legal equivalent of a handwritten one — and because HomeSign records the consent statement, the version the signer accepted and a full audit trail alongside it, you have the evidence to back that up if it's ever questioned.

Common questions about HomeSign

Is a HomeSign signature actually legally binding?

Yes, for the documents estate agents send with HomeSign — terms of business, instruction paperwork and similar. Electronic signatures are legally recognised in England and Wales under the Electronic Communications Act 2000 and the UK eIDAS Regulation, and an electronic signature captured this way is treated as the legal equivalent of a handwritten one. Before signing, every signer is shown a consent statement and the exact wording and version they accepted is stored against their signature. Does the seller need to create an account to sign?

No. They get a secure link by email, open it on any phone, tablet or laptop, and sign directly in the browser. There is nothing to download, register for or remember a password for.

What happens if they don't sign straight away?

The envelope sits as "pending" on your dashboard, then flips to "viewed" the moment they open the link. If it is still unsigned two days later HomeSign sends an automatic reminder, and again at five days — a signer is never chased more than once in 24 hours, and the reminders stop the instant they sign. You can also resend or void the envelope by hand at any time.

Can I reuse the same terms of business template for every instruction?

Yes. Upload the PDF once, place the signature and date fields once, and save it — personally, or shared across your whole branch. Every future send picks up your latest saved version automatically. Envelopes you have already sent stay locked to the exact layout they went out with, so editing the template later never quietly changes a document a seller has already signed.

Can more than one person sign the same document?

Yes, two ways. Send to several recipients and each gets their own copy tracked separately — useful for a buying couple who need to sign individually. Or bring co-signers together on one shared document, where each signature appears on the same PDF as it is added — useful for a joint agreement everyone needs to see fully countersigned.

What is self-sign, and how is it different from sending a document?

Self-sign is for a document you need to sign yourself — countersigning something, initialling a page — with no recipient and nothing to send. You place your signature on the PDF and download it straight from the browser. The file is processed entirely on your own device and is never uploaded to HomeSign's servers, so there is no envelope, no audit trail and no record stored against a lead.

What's kept if a dispute comes up months later?

Every step — sent, each reminder, viewed, consented, signed, completed — is written to an append-only audit log with a timestamp, IP address and device, and it can never be edited or deleted afterwards. When the envelope completes, a Certificate of Completion is generated with the full timeline and a SHA-256 fingerprint of the signed PDF, then appended to the document itself, so tampering with even a single pixel afterwards would change the fingerprint.

Where does the signed document end up?

Filed automatically against the valuation lead or contact you sent it to. You can download the signed PDF plus its Certificate of Completion from the Sent dashboard at any time, alongside a full audit timeline for that specific envelope.

What happens automatically once the terms are signed?

Where switched on for your account, signing can trigger the next compliance step without you lifting a finger: an AML identity check, a Material Information pack invite to the seller, and a Land Registry Proof of Ownership order. None of these spend your money without you — the Land Registry step lands as a prefilled link in your inbox rather than an automatic charge, and an AML check that runs automatically consumes one of your agency's existing credits.

Does HomeSign cost extra?

HomeSign is part of your home.co.uk agent account — there is no separate e-signature subscription to run alongside it. Downstream automations you choose to enable, like AML checks, use your account's existing credits in the same way as running them by hand.

Can I send documents that are not terms of business?

Yes. Any PDF can go out for signature — a variation, a disclosure form, an internal agreement. Anything you send repeatedly is worth saving as a template so the fields are already placed for next time.
